Is this ride not a water attraction?  If so, assuming it isn't cracked and assuming they were actually pumping water through it, how exactly could it not be properly maintained?

Yes Wade, the Tornado is one of the funnel  slides in the water park. The only part of the ride that the park could have failed to maintain was the innertube, unless water was prevented from moving the tube down the funnel.
